Widow Receives ₹4.5 Crore Settlement and High Court Quashes FIR

Mumbai: The Bombay High Court has recently quashed an FIR following a settlement reached between the parties involved, marking a significant moment for justice in a complicated case. The respondents’ advocate, Mubarakka Lokhandwala, along with Adv Vijay Jha, successfully argued for the dismissal of the FIR, citing the agreed-upon compensation of ₹4.5 crore received by their client, Ms. Meena Tiwari.

The case initially involved allegations of cheating, where five individuals were remanded to judicial custody for failing to deliver a flat that Ms. Tiwari had purchased for ₹1 crore. This situation not only caused financial distress but also emotional turmoil for the elderly widow, raising broader concerns about the treatment of vulnerable individuals in the legal system.

Ms. Tiwari’s lawyer, Ghanshyam Upadhyay, expressed serious concerns regarding the investigation process, claiming that the investigation officer (IO) may have acted in collusion with the accused. He pointed out, “Usually, police custody is sought during the second remand. However, in this case, the police asked for judicial custody, which is shocking.” 

The High Court’s decision to quash the FIR highlights the effectiveness of settlements in resolving civil disputes and underscores the importance of ensuring fair treatment for all individuals within the legal framework. This case serves as a critical reminder of the complexities involved in legal matters, particularly for those seeking justice against more powerful adversaries.
